Our client was the driver of a vehicle pulled over for a traffic stop. After explaining the reason for the stop, the Officer informed our client that he could smell the odor of cannabis coming from within the car. The Officer then requested permission to search our client’s car, which he granted. After the search, the officer found some shake on the floorboards and the remnants of a smoked marijuana cigarette or a “roach.” The officer arrested our client and took him to jail. After receiving the case, we immediately attacked the weight of “drugs” found in the car, the location of the items were found in and the officers lack of information with regards to these things in his report. Without being able to answer the questions or provide this information, the State dismissed the case against our client.
