Florida DUI Arrests By The Numbers

August 1, 2024

Each year the FLHSMV publishes data about the number of traffic infractions issued across the state.  We dive deep into these numbers to get a better understanding of trends in traffic enforcement here in Florida. We always look at criminal traffic arrests which include the most notorious: DUI. Let’s take a look at the numbers.

Florida Criminal Traffic Arrest Overview

In 2023, there were 340,450 criminal traffic arrests. While this category includes charges like DUI, reckless driving, racing on the highway, and fleeing, the overwhelming majority of criminal traffic arrests are actually for driving without a license or knowingly driving with a suspended license. Those two charges together amounted to over 212,000 arrests last year.

Florida DUI Arrests By The Numbers

In 2023, Florida law enforcement made 44,185 arrests for DUI. This is very similar to previous years. In fact, the number of DUI arrests going back to 2017 is remarkably similar with the exception of 2020 during peak COVID. Check out the chart below.

Where Is DUI Enforcement Most Strict In Florida?

Of the 44,000 arrests for driving while under the influence in the state of Florida during 2023, 7995 or 18% happened in the undisputed hotspots for DUI: Hillsborough and Pinellas counties. Over the last few years, this region has topped the list beating out more populated areas such as Miami.

By comparison, South Florida’s Miami and Broward counties had 5,218 combined. You would have to add Palm Beach County in order to hit Tampa’s numbers. In 2024, Florida’s DUI hotspot shows no signs of slowing down. During major holiday’s HCSO is out in force, just over Memorial Day weekend there were 40 DUI arrests and over 500 traffic stops according to this release.

Miami Dade 1904 Arrests
4.3%
Palm Beach 2778 Arrests
5.2%
Broward 3314 Arrests
7.5%
Pinellas County 3884 Arrests
8.8%
Hillsborough County 4151 Arrests
9.4%

Where Is DUI Enforcement Getting Tougher?

Many of the counties we track arrested less people for DUI in 2023 than in 2022. However, there is one major exception in South Florida. DUI enforcement in Broward county seems to be picking up steam. In 2022, agencies in this area made an abnormally low 2279 arrests however, during 2023, that number surged to 3314. This is roughly a 20% increase! The increase came from local police agencies while the Sheriff’s Office and FHP arrests for DUI were relatively flat. What does this mean? As local police ramped up their traffic enforcement, DUI arrests subsequently trended higher. While we never condone driving under the influence ever, it’s probably a good idea to be extra careful in Broward these days. Just one officer in Broward has racked up over 450 DUI arrests according to this report.

How To Avoid A DUI In Florida

Driving under the influence (DUI) in Florida is not something anyone wants to deal with. The penalties are harsh, and the consequences can stick with you for years. So, how do you make sure you stay on the right side of the law? Let’s break it down.

First off, the simplest and most foolproof method: don’t drink and drive. Florida law is strict, and the legal limit for blood alcohol content (BAC) is 0.08%. Even a couple of drinks can put you over the limit, depending on various factors like your weight and metabolism. If you’re planning to have a night out, consider these alternatives:

  1. Designate a Driver: Before heading out, agree on someone who will stay sober and drive everyone home safely.
  2. Use Ride-Sharing Apps: Services like Uber and Lyft are lifesavers. They’re easy to use and can be cheaper than a DUI fine.
  3. Public Transportation: Depending on where you are in Florida, buses and trains can be convenient and cost-effective.
  4. Stay Over: If you’re at a friend’s place or near a hotel, consider staying the night instead of driving home.

Another crucial tip: Be aware of medication. Some prescriptions can impair your ability to drive just as much as alcohol. Always read the labels and talk to your doctor about how your medication might affect your driving.

Lastly, know your limits. Even if you feel fine, your BAC could tell a different story. Portable breathalyzers are a great investment—they can give you a quick read on your BAC and help you make an informed decision.

Staying informed and planning ahead can save you from a DUI charge and keep the roads safer for everyone. So next time you’re out in Florida, make smart choices and avoid the headaches of a DUI.

Ask A DUI Lawyer How To Navigate Your DUI Arrest

Finding yourself arrested for a DUI can be overwhelming and frightening. The immediate aftermath is critical, and calling a DUI lawyer should be your top priority. Here’s why:

A DUI lawyer knows the intricacies of the law. They can navigate the complex legal system, which is often daunting for those without a legal background. From the moment of your arrest, a lawyer can ensure your rights are protected, preventing any potential missteps by law enforcement from being overlooked.

Evidence is crucial in DUI cases. A skilled attorney will scrutinize every detail, from the accuracy of breathalyzer tests to the legality of the traffic stop. They might find errors or procedural mistakes that could weaken the prosecution’s case against you.

Penalties for DUIs can be severe, including hefty fines, license suspension, and even jail time. A DUI lawyer will work to minimize these consequences, possibly negotiating for reduced charges or alternative sentencing options like community service or rehabilitation programs.

Moreover, having a lawyer can significantly reduce stress. They handle court appearances, paperwork, and negotiations, allowing you to focus on your personal life and responsibilities.

In short, a DUI charge is serious, but having a dedicated lawyer on your side can make a substantial difference in the outcome. Don’t go through it alone—call a DUI lawyer immediately after your arrest to protect your future.
