When the made contact, the officer noticed the odor of alcohol, red bloodshot eyes, and the Defendant had slurred speech. The officer requested that the Defendant submit to roadside exercises and he refused. He was placed under arrest for DUI. The officer then asked the Defendant to provide a breath sample. The Defendant also refused to do this. The attorney for the firm prepared the case for trial. The State dropped the DUI case.
