The Defendant attempted to perform field testing but was ultimately arrested after a poor performance on the exercises. The Defendant then refused to provide a breath sample after the arrest. The Defendant was previously convicted of DUI in 2021, meaning a DUI conviction would require a jail sentence and a 5 year license revocation.
